Q. How long does it take if I decide to declare Voluntary Bankruptcy?
A. Usually, we can complete your documentation and lodge it with the Government Bankruptcy Office within a week of your first contact. Once you are bankrupt, your unsecured creditors are obliged to stop harassing you.
Q. Can I travel overseas if I am bankrupt?
A. You will need to inform your Trustee of the reason and the exact time of your trip. Most overseas trips that have a family or business purpose and are funded by a third party, will generally be approved by your Trustee. Allow about 2 weeks from the time you seek your trustees approval.
Q. I have a car loan and wish to keep my car, but am considering Voluntary Bankruptcy - can I keep my car?
A. If the car loan is up to date, you can usually keep your car as it is not an asset that you own. If you own your car, the value needs to be $7,050 or less - this amount is based on auction/trade-in value and not private sale value. If you have a car loan, the value is mostly irrelevant, as long as you do not have too much equity in the car.
Q. I have a mortgage but am considering Voluntary Bankruptcy - will I lose my house?
A. This depends on the amount of equity you have in your home and also if the loan repayments are up to date. If you have very little to no equity in your home, there is no value in a sale, thus you would be able to keep your home. If you own or have reasonable equity in the home, your Trustee will most likely sell your home to repay your creditors. You must also understand that your trustee will place a caveat over your property and the trustee can act on this caveat for up to 9 years.
Q. What happens if I enter a Part 9 Debt Agreement and I can no longer afford the repayments?
A. In most cases, the Debt Agreement would have to be cancelled and your creditors have the right to take action against you to recover the debt. If you find yourself in this situation, you should consider voluntary bankruptcy.
