Applying for Bankruptcy can be the most positive step towards a fresh start - a debt free start. And it can be done in a matter of days - by A1 Debt Assistance.
There are many stories about bankruptcy information and what the consequences of clearing your debt via bankruptcy are.
Reality commonly varies drastically from what you have been told by Debt Collectors or other people not familiar with the Bankruptcy Act. They often give you the bankruptcy scare treatment, or are simply ignorant to the fact that bankruptcy is actually a law that is in place to protect people from creditors when they have no longer the means to pay these - you are entitled to use money for your living costs and put food on the table.

To go bankrupt, you must be insolvent.
Insolvency means that you no longer can meet your payment obligations on all your bills and living costs, as and when they fall due. Do not consider bankruptcy for any other reason.
Importantly, you will not lose everything. Nobody will take your furniture, TV, computers, Whitegoods etc - unless you bought these items on a secured loan - which is highly unlikely. Most store loans are actually credit cards or lines of credit and customers don't always realise this and are rarely told.
Forget the nonsense of the Bankruptcy Stigma - it is a psychological weapon used by some debt collection agencies. Your name will not be published, unless you are some high flying celebrity and the media found out about your financial problems. Your friends and neighbors would usually only find out if you tell them about it, and you may be surprised to hear that one or the other may have gone through bankruptcy themselfes at some time.
A1 Debt Assistance is a family business, working from a home office. As such, our overheads are much lower than most and our fees are amongst the lowest in Australia, if not THE lowest.
Bankruptcy is a fresh start. It can be a very positive experience if done correctly!
If debt collectors would threaten you with the truth about bankruptcy, the bankruptcy rate in Australia would go through the roof and debt collectors would find it very hard to put pressure on people that really do not have the luxury of entering into a payment agreement with them.
If you have credit card debts or any other debt problems that you simply can no longer pay for - you should contact A1 Debt Assistance and let us explain how entering into Voluntary Bankruptcy would impact on your exact situation. The phone consultation is free and fully confidential.
Not filing for bankruptcy holds far more severe consequences.
Until you are bankrupt, your assetts are not protected under the Bankruptcy Act. Any of your creditors can get a judgement against you and can send the sherif around to your home to collect your TV, car, furniture and anything of value. They sell it off at auction and because it sells very cheap, you are left without your goods and still with a debt to the creditor if the sale does not cover the amount of your actual debt.
A creditor can also get a court order to have money taken out of your wages - this is called garnishing wages. If you already have your wages garnished and can no longer survive on the income that you are left with, bankruptcy will stop your wages from being garnished - unless it is for the payment of fines.
Financial stress can make you feel sick, the pressure impacts on your health, relationships and every other aspect of your live. Debt consolidation is not always your best option - it often simply prolongs your suffering and you still end up with more debt than your budget can cope with.
Financial Assistance from family and friends can often help, but only if you are certain that you can repay these debts based on your current income - not on the possible higher income around the corner. Work out your budget with what you make now - not what you hope to earn in the future. You need to be realistic to be able to get on top of your financial problems. There is a lot you can learn from free online bankruptcy information and other related subjects - however, the information on websites has to be generic to suit all. Until we know your exact circumstances, we can not know how to best help. Make use of our free phone conultation service - remember it is strictly confidential, but you need to be truthful with us and tell us about all your debts - we can only help if we understand what we are dealing with.

Bankruptcy does not stop you from operating a business.
If you trade under an ABN, you can continue operating in your business during bankruptcy, but may have to make some changes to how you operate. This is subject to your type of business. For example, if you are a tradie and you operate under a business name instead of your own name, you would have to tell all your clients and suppliers that you are an undischarged bankrupt. However, if you trade under your own name, you only have to mention that you are bankrupt for jobs over a certain value.
If you are the director of a company, you must resign as a director. You can not be director of a company for the duration of your bankruptcy. However, if you are the sole director - it may be worth your while to consider changing your structure and trade under an ABN as a sole trader - this can be done by de-registering your company via ASIC if your company has no liabilities. If your company has debts thaat you can not pay - you need to stop trading immediately as this would mean that you are trading whilst insolvent - inform ASIC. If you wish for A1 Debt Assistance to handle your bankruptcy - we will advise you on your options based on your type of business.
